As a booking agent, Nihosi Travel acts as an intermediary for products and services that are not directly supplied by us, such as air carriage, ground transportation, hotel accommodations, meals, tours, and cruises. We are not a co-vendor of such products and services, and you will enter into a separate contract with the Supplier in connection with these products and services.

Travel Documents and Health Requirements

It is the responsibility of the traveller to ensure they have the necessary travel documents, including passports, visas, and health certificates, and to comply with all applicable laws and regulations. Nihosi Travels & Tours Pvt. Ltd. is not responsible for any issues that arise due to the traveller’s failure to comply with these requirements.

Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and data compilations, is the property of Nihosi Travels & Tours Pvt. Ltd. or its content suppliers and protected by international copyright laws. Travel Insurance

At Nihosi Travels, the safety and well-being of our passengers is of the utmost importance. That’s why we require all passengers to obtain comprehensive travel insurance before embarking on any of our tours. This insurance should cover personal injury, medical expenses, repatriation, and evacuation.

It is important to note that the cost of the tour does not include insurance and it is the responsibility of the passenger to purchase their own coverage. Failure to do so may result in the cancellation of your participation in the tour or certain activities.

We strongly recommend that your travel insurance policy includes coverage for cancellation, curtailment, and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience occurring to the passenger.

Please be aware that Nihosi Travels & Tours Pvt. Ltd. will not accept liability for loss, theft of, or damage to baggage or personal effects. We also will not accept responsibility for, and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by Nihosi Travels such as hotels, vessels, expedition vehicles, or any other mode of transportation.

It is important that when obtaining travel insurance, the passenger informs the insurer of the type of travel to be undertaken. This will ensure that you have the appropriate coverage for your trip.

Passengers must be able to provide proof of adequate insurance cover purchased if requested by the group leader or Nihosi Travels representative. The company reserves the right to cancel or suspend your participation on a trip or in certain activities that comprise part of a trip, at any time, including after the commencement of your trip, with no right of refund, if you are unable to provide proof of insurance when requested.

Payment Terms and Conditions

At Nihosi Travels, we understand the importance of flexibility and convenience when it comes to planning your next holiday. That’s why we offer a variety of payment options to suit your needs.

A non-refundable deposit is required to secure your reservation and hold your spot on the tour or package. This deposit enables us to make the necessary arrangements with our suppliers, but it does not guarantee the price of the tour. The final price of your travel arrangements will be confirmed once full payment has been received and all necessary travel documents have been issued.

We accept various forms of payment, including credit cards, bank transfers, and e-wallets. However, we reserve the right to refuse personal checks as a method of payment.

It is important to note that after full payment has been received, the conditions of the contract with your supplier may permit them to increase the cost of your arrangements. If we are acting as your booking agent, we will pass on any such increase to you as soon as we become aware of it. If we have arranged a package, changes in transportation costs, including the cost of fuel, taxes, fees, and exchange rates, may also affect the price of your travel arrangements.

We recommend that you review all terms and conditions carefully before making any payments and if you have any questions or concerns, please do not hesitate to contact us.

Cancellation by the Client

Any cancellation by a Client must be made in writing and acknowledged by Nihosi Travels & Tours Pvt. Ltd. (the “Company”). The date on which the request to cancel is received by the Company will determine the cancellation charge applicable.

Cancellations within the balance payment period (60-0 days prior to departure) are as follows:

(1) 60 days or more prior to departure, deposit will be retained by the Company.
(2) 59-30 days, 70% of the tour fee will be forfeited.
(3) 29-20 days, 85% of the tour fee will be forfeited.
(4) 19-0 days, 100% of the tour fee will be forfeited.

It is important to note that no refunds will be made if you voluntarily leave a trip for any reason after the trip has begun. Additionally, no refunds will be given for any unused accommodations, transportation, sightseeing, meals, or services.

Cancellation by the Client

Nihosi Travels & Tours Pvt. Ltd. reserves the right to cancel any tour at any time for any reason, but will make every effort to avoid cancelling a tour less than 42 days before departure. Reasons for cancellation may include, but are not limited to, Force Majeure, natural disasters, flight cancellations, strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather conditions, or other unforeseen circumstances.

In the event of tour cancellation by Nihosi Travels & Tours Pvt. Ltd., clients will be offered a full refund of their tour price. If the tour is part of a guaranteed departure, clients will also have the option to take an alternative tour of equal value.

Please note that the company is not responsible for any additional expenses or losses incurred by clients as a result of the tour cancellation such as visa fees, vaccinations, non-refundable flights or rail tickets, car parking fees, loss of earnings, or loss of enjoyment. Additionally, the company reserves the right to make significant alterations to the tour itinerary, such as changes in airline carrier or flight schedule, the substitution of a vessel, modification of itineraries, and changes in accommodation, provided that the departure and arrival dates remain unchanged and the accommodation is of the same category.

Handling Complaints

If you encounter any issues during your holiday, it is important that you bring them to the attention of the relevant service provider (such as your hotel) immediately. If they are unable to resolve the matter to your satisfaction, please contact us as soon as possible through our website (www.nihositravels.com), email (info@nihositravels.com) or phone (+9779841771941) so that we can investigate your complaint and try to rectify the problem while you are still on your trip. Failure to promptly contact us may affect your rights under this agreement.

Itinerary changes & unforeseen circumstances

Nihosi Travels & Tours Pvt. Ltd. reserves the right to make necessary changes to an itinerary at any time, due to unforeseen circumstances such as weather conditions, traffic or road conditions, mechanical or technical issues with vehicles or boats, or faulty facilities on a coach, train, or boat. Every effort will be made to rectify these issues as quickly as possible, and in some instances, it may be necessary to replace the vehicle or boat that cannot be repaired. However, we cannot accept any responsibility for delays caused by any form of breakdown.

Please note that mountain adventures are always unpredictable and that bad weather in mountain regions can cause domestic flight delays. In case of delayed domestic flights, Nihosi Travels & Tours Pvt. Ltd. will cover the costs of accommodation and food prior to your trip. However, in case of delayed return flights, the client will be responsible for all additional expenses, including food and accommodation costs. If you wish to make alternative arrangements, such as a helicopter flight, to avoid flight delays, all additional costs will be the responsibility of the client.

Additionally, Nihosi Travels & Tours Pvt. Ltd. does not accept responsibility for costs incurred as a result of missed international flights, but we will assist in making alternative arrangements wherever possible. Please note that while on the tour, we may have to make some changes in the itinerary due to unforeseen circumstances, and we ask for your understanding and cooperation in such situations.

Cancellation of a Tour by Nihosi Travels

Nihosi Travels & Tours Pvt. Ltd. reserves the right to cancel a tour at any time, due to Force Majeure, or the Client’s failure to pay the final balance or due to natural disasters, flight cancellation, consequences of strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather conditions, or other unforeseen occurrences. In the event of a tour cancellation, Nihosi Travels & Tours Pvt. Ltd. will refund the trip price only. If the Company cancels a departure which is guaranteed to run, we will refund the trip price, or the client is entitled to take an alternative trip of the same value.

Please also note that significant alterations do not include a change of airline carrier, flight time tables or itineraries provided the departure and arrival dates remain unchanged, the substitution of a vessel, modification of itineraries, and change in cabin category or hotel accommodation provided it is of the same category.

The Company is not responsible for any incidental expenses or consequential losses that the client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.

Itinerary Changes

It may be necessary, sometimes at short notice, to make changes to an itinerary due to weather, traffic or road conditions. Regrettably, coaches, trains, and boats do occasionally break down, or suffer mechanical or technical problems, or certain facilities on board a coach, train, or boat may become faulty. Every effort will be made to rectify such issues as quickly as possible. In some instances, it may be necessary to replace the vehicle or boat which cannot be repaired. We cannot accept any responsibility for delays caused by any form of breakdown.

Please note that mountain adventures are always unpredictable. Bad weather in mountain regions can cause domestic flight delays.

In case of delayed domestic flights, Nihosi Travels & Tours Pvt. Ltd. will meet departing city accommodation (Guest House) and food (Lunch & Breakfast) costs prior to your trip. However, in case of delayed return flights, the client is responsible to bear all additional expenses including food and accommodation costs. If you wish to make an alternative arrangement such as a Helicopter flight to avoid flight delays, all additional costs would be your responsibility.

Moreover, Nihosi Travels & Tours Pvt. Ltd. does not accept any responsibility for costs incurred as a result of missed international flights but would assist to make alternative arrangements wherever possible. Please also note that while on the field, we may have to make some changes to the itinerary due to unforeseen circumstances.

Itinerary Changes by Nihosi Travels

Nihosi Travel’s aim is to operate all tours as advertised; however, it may prove necessary or advisable to vary or modify a tour itinerary or its contents due to prevailing local conditions or any other reason.

It is important to note that Nihosi Travels & Tours Pvt. Ltd. reserves the right to make changes to the itinerary or schedule of any tour at any time, including but not limited to changes in transportation, accommodation, activities, and sightseeing. These changes may be necessary due to factors such as weather, traffic, road conditions, availability of accommodations, or other unforeseen circumstances.

In the event that a change is made to the itinerary or schedule of a tour, Nihosi Travels & Tours Pvt. Ltd. will make every effort to provide suitable alternative arrangements of comparable value. However, please note that in some cases, these alternative arrangements may not be available or may not be of the same standard as the original itinerary. In such cases, Nihosi Travels & Tours Pvt. Ltd. will not be liable for any costs or loss of enjoyment as a result of these changes.

It is also important to note that Nihosi Travels & Tours Pvt. Ltd. will not be responsible for any costs incurred by the Client as a result of changes made to the itinerary or schedule of a tour, such as the cost of non-refundable flights or other travel arrangements.

Itinerary Changes by Passenger

At Nihosi Travels, we understand that plans can change and we want to make it as easy as possible for our clients to make adjustments to their bookings. However, we do ask that all changes, amendments, or additions are confirmed with us at least 60 days prior to the departure date to avoid any cancellation or amendment fees. Additionally, it is not possible to add new passengers to a booking once it has been completed.

If changes are requested within the following time frames, the following fees will apply:

  • Name and Tour Date changes requested within 60-30 days of departure will incur an amendment fee of $30 per person.
  • Name and Tour Date changes requested within 29-15 days of departure will incur an amendment fee of $60 per person.
  • Changes requested within 14 days of departure will be made at the sole discretion of Nihosi Travel and may incur additional fees.

Similarly, if a passenger wishes to change the tour destination, the following fees will apply:

  • Tour Destination changes requested within 60-30 days of departure will incur an amendment fee of $ 45 per person.
  • Changes requested within 29 days of departure will be made at the sole discretion of Nihosi Travel and may incur additional fees.

It is important to note that changing the tour date and/or the destination is subject to availability of the new requested date and/or the destination. If the revised tour has a higher price or local payment, the price difference must be paid by the passenger. Additionally, it is not possible to transfer the booking to travel dates outside of seasonal dates covered in the Nihosi Travel’s brochure or by the relevant edition of the website valid at the time the original booking was made.

Finally, please note that in the event of booked pre-tour and post-tour accommodation being unused, hotel cancellation charges may apply and will be the responsibility of the passenger regardless of the circumstances.

Visas & Travel Documentation

It is the responsibility of the passenger to obtain any necessary visas, passports, health certificates, or other travel documentation required for their trip with Nihosi Travels & Tours Pvt. Ltd. Failure to comply with these requirements may result in additional costs for the passenger. It is important to note that it is the passenger’s responsibility to ensure that they have the correct visa documentation for the countries they will be traveling to, and Nihosi Travels & Tours Pvt. Ltd. cannot accept responsibility if a passenger is refused entry to a country due to lack of proper documentation. Passengers should also ensure that their passport is valid for at least six months beyond the duration of their trip. Visa for Nepal is available on arrival, but for Tibet and Bhutan, the company can make necessary arrangements on request. For India, the client will have to acquire the visa from their home country.

Medical Conditions and Special Requirements

It is the responsibility of the passenger to inform Nihosi Travel & Tours Pvt. Ltd. in writing at the time of booking of any medical conditions, physical disabilities, or any other mental or physical conditions that may affect the passenger’s ability to travel. Failure to notify Nihosi Travel of any such condition may result in the passenger being denied travel and a 100% cancellation fee. Some tours may not be suitable for certain individuals due to age, mobility, pregnancy, or physical or mental conditions. It is the passenger’s responsibility to verify the suitability of the tour before booking. Nihosi Travel is not required to provide any special accommodations unless previously agreed to in writing. Nihosi Travel will make every effort to accommodate special requests such as dietary needs, but these requests are not considered part of the contract and Nihosi Travel is not liable for not providing them. Medical facilities vary by country, and Nihosi Travel makes no representations or warranties regarding the standard of medical treatment in any destination.

Injuries and Evacuation

In the unfortunate event that a client does require evacuation due to injury or health condition, Nihosi Travels & Tours Pvt. Ltd. will provide assistance and support to the best of our abilities. However, it is important to note that any costs associated with evacuation, including those of medical treatment, transportation, and any other related expenses, will be the sole responsibility of the client. It is highly recommended that all clients have adequate insurance coverage to ensure they are prepared for any unforeseen circumstances during their travels with us.

Disclaimer of Warranties

We provide our website and services, including all content, information, products, and services, on an “as is” and “as available” basis, without any warranty, express or implied. We do not guarantee the accuracy, completeness, or reliability of any information or content provided on our website or through our services. Your use of our website and services is at your own risk, and we will not be held responsible for any damages that may arise from the use of our website or services.

This policy applies to situations where a client voluntarily or involuntarily leaves the tour early, arrives late to the tour, or misses any services due to circumstances beyond our control, such as sickness, death of a family member, or any other unforeseen events. We advise all travelers to carefully plan and consider their travel arrangements to ensure that they can fully participate in and enjoy their tour experience.

Limitation of Liability

Nihosi Travels & Tours Pvt. Ltd. will not be liable for any injury, loss, damage, delay, or expense arising from any cause whatsoever, including negligence, accident, or any other cause, beyond our control. We are not liable for any indirect, special, or consequential damages arising out of or in connection with the use of our website or services.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Nihosi Travels & Tours Pvt. Ltd. is located. Any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

Booking a trip with Nihosi Travels & Tours Pvt. Ltd.

A trip with Nihosi Travels & Tours Pvt. Ltd. refers to any adventure, tour, trekking, expedition, or any other travel product or itinerary that you book with us. Your booking will only be considered definite and a contract will come into existence once the Company sends a confirmation invoice or email.

It is important to note that prior to your booking being confirmed and a contract becoming effective, Nihosi Travels & Tours Pvt. Ltd. reserves the right to make changes to the prices as advertised in our brochure.

Please be aware that, upon booking, the only warranties and conditions that will apply to your trip are those expressed in this agreement. Any prior agreements, descriptions of services, collateral agreements, or conditions will not be recognized by the Company and will not be binding on Nihosi Travels & Tours Pvt. Ltd.

Amendments to Terms and Conditions

Nihosi Travels & Tours Pvt. Ltd. reserves the right to update and modify these terms and conditions at any moment.
