The following terms and conditions govern all use of the nihositravels.com website and all content, services and products available at or through the website (taken together, the Website). The Website is owned and operated by Nihosi Travels & Tours Pvt. Ltd. (“Nihosi Travels”).

Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the web site, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these terms and conditions are considered an offer by Nihosi Travels, acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 13 years old.

Products and Suppliers

We sell a variety of travel related products from different suppliers and service providers (``Suppliers``). Each Supplier has its own terms and condition that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Certain software and content found on our website are owned or licensed by us or our Suppliers, your use of which may be subject to further conditions. Our website, which is referred throughout this Agreement, can be found at www.nihositravels.com
Nihosi Travel is acting as intermediary or a ``Booking Agent`` for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services.

Travel Insurance

The passenger accepts that the cost of the tour does not include insurance & it is mandatory that all passengers obtain travel insurance while travelling with Nihosi Travels covering personal injury, medical, repatriation, and evacuation expenses.
Your travel insurance must cover accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability.
Passengers must be able to provide proof of adequate insurance cover purchased if requested by the group leader or Nihosi Travels representative.
It is strongly recommended the coverage be extended to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the passenger.
Nihosi Travels & Tours Pvt. Ltd. will not accept liability for loss, theft of, or damage to baggage or personal effects. Personal belongings lost or stolen while unattended by the passenger in public lounges or other public areas, whether on board a vessel, train, bus, or other mode of transportation, publicly owned or operated by Nihosi Travels or elsewhere, are not reimbursable. Losses due to ordinary wear and tear or acts of God are not reimbursable.
Nihosi Travels & Tours Pvt. Ltd. will not accept responsibility for, and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by the Nihosi Travels such as hotels, vessels, expedition vehicles, or any other mode of transportation. When obtaining travel insurance, the passenger must ensure the insurer is aware of the type of travel to be undertaken.
The company reserves the right to cancel or suspend your participation on a trip or in certain activities that comprise part of a trip, at any time, including after the commencement of your trip, with no right of refund, if you are unable to provide proof of insurance when requested.

Deposits and Payment

Any deposits from you are non-refundable. Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier. We will advise you of the date that full payment is required. Upon your provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding Suppliers.

We reserve the right to refuse personal checks as a method of payment. After full payment, the conditions of the contract with your Supplier may permit them to increase the cost of your arrangements. If we are acting as your Booking Agent, we will pass on any such increase to you as we become aware of such increase. If we have arranged a package, changes in transportation costs including the cost of fuel, taxes, fees and exchange rates mean that the price of your travel arrangements may change after you have paid in full.

CANCELLATION BY THE CLIENT

Any cancellation by a Client must be made in writing and acknowledged by the Company. The date on which the request to cancel is received by the Company or its Agents will determine the cancellation charge applicable.
Cancellations within the balance payment period (60-0 days prior to departure) are as follows:
(1)60 days or more prior to departure, deposit to be retained by Nihosi Travels & Tours Pvt. Ltd.
(2)59-30 days 70% of tour fee is forfeited
(3)29-20 days 85% of tour fee is forfeited
(4)19-0 days 100% of tour fee is forfeited
Please note that no refunds will be made if you voluntarily leave a trip for any reason after the trip has begun. No refunds will be made for any accommodation, transport, sightseeing, meals or services not utilized.

CANCELLATION OF A TOUR BY THE COMPANY

Nihosi Travels & Tours Pvt. Ltd. reserves the right to cancel a tour in any circumstances but will not cancel some tour less than 42 days before departure, except for Force Majeure, or the Client’s failure to pay the final balance or due to natural disasters, flight cancellation, consequences of strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather conditions, or other untoward occurrences. Nihosi Travels & Tours Pvt. Ltd. reserves the right to cancel any trip, including a guaranteed trip, prior to departure due to reasons beyond its control. In such a case, Nihosi Travels & Tours Pvt. Ltd. will refund the trip price only. If the Company cancels a departure which is guaranteed to run, we will refund the trip price, or you are entitled to take an alternative trip of the same value.
Please also note that significant alterations do not include a change of airline carrier, flight time tables or itineraries provided the departure and arrival dates remain unchanged, the substitution of a vessel, modification of itineraries, and change in cabin category or hotel accommodation provided it is of the same category.
The Company is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.

If You Have A Complaint

If you have a problem during your holiday, please inform the relevant Supplier (e.g. your hotel) immediately. Should they be unable to resolve the matter, please immediately contact us, either through the office or through www.nihositravels.com or you may contact with any possible methods Email: [email protected] / phone : +9779851191947. If you fail to timely contact us, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect your rights under this Agreement.

Itinerary Changes

It may be necessary, sometimes at short notice, to make changes to an itinerary due to weather, traffic or road conditions. Regrettably, coaches, trains, boats do occasionally break down, or suffer mechanical or technical problems, or certain facilities on board a coach, train, boat may become faulty. Every effort will be made to rectify such issues as quickly as possible. In some instances, it may be necessary to replace the vehicle or boat which cannot be repaired. We cannot accept any responsibility for delays caused by any form of breakdown.
Please note that mountain adventures are always unpredictable. Bad weather in mountain regions can cause domestic flight delays.
In case of delayed domestic flights, Nihosi Travels & Tours Pvt. Ltd. will meet departing city accommodation (Guest House) and food (Lunch & Breakfast) costs prior to your trip. However, in case of delayed return flights, the client is responsible to bear all additional expenses including food and accommodation costs. If you wish to make an alternative arrangement such as Helicopter flight to avoid flight delays, all additional cost would be your responsibility.
Moreover, Nihosi Travels & Tours Pvt. Ltd. does not accept any responsibility for costs incurred as a result of missed international flight but would assist to make alternative arrangements wherever possible. Please also note that while on the field, we may have to make some changes in the itinerary due to unforeseen circumstances.

Changes by Nihosi Travels

Nihosi Travel’s aim is to operate all tours as advertised accepts that it may prove necessary or advisable to vary or modify a tour itinerary or its contents due to prevailing local conditions or any other reason.
Nihosi Travels & Tours Pvt. Ltd. reserves the right at any time to cancel or change any of the facilities, accommodations, services or prices described in our brochure or online and to substitute alternative arrangements of comparable monetary value or charge a supplement locally if alternative arrangements cannot be made, without compensation to the Client and accepts no liability to the Client whatsoever for costs or loss of enjoyment as a result of these changes. Where a major change is made prior to departure, the Client will have the choice of either: accepting another tour of equivalent or superior standard; or a choice of specified travel arrangements of a lower standard to those previously booked together with a refund of the difference in price; or cancelling the tour and obtaining a full refund. The definition of the “major change” is a change that is reasonably required but will depend on the individual tour and circumstances.

Changes by Passenger

All changes, amendments or additions must be confirmed prior to 60 days of the departure date to avoid cancellation or amendment fees. No new passengers may be added to a booking once completed.
a) Name and Tour Date changes requested within;
60-30 days of departure will incur an amendment fee of $30 per person;
29-15 days of departure will incur an amendment fee of $60 per person;
14 days of departure will be made at the sole discretion of NIhosi Travel.
b) Tour Destination changes requested within;
60-30 days of departure will incur an amendment fee of $ 45 per person;
29 days of departure will be made at the sole discretion of Nihosi Travel.
Changing the tour date and/or the destination is subject to availability of the new requested date and/or the destination. If the revised tour has a higher price and/or local payment, the price difference must be paid by the passenger.
It is not possible to transfer the booking to travel dates outside of seasonal dates covered in the Nihosi Travels brochure or by the relevant edition of the web site valid at the time the original booking was made. Hotelier cancellation charges are liable to be paid by the passenger in the event of booked pre-tour and post-tour accommodation being unused whatever the circumstances are.

Visas & Travel Documentation

It is passenger’s responsibility to obtain any visas, passports, health certificates or other travel documentation required. You must carry a valid passport and have obtained the appropriate visas when traveling with Nihosi Travels & Tours Pvt. Ltd. It remains the passenger’s responsibility to ensure that these documents are in order and meet any additional costs incurred as a result of failure to comply with such requirements. It is your responsibility to ensure that you are in possession of the correct visas for the countries you are traveling to. Nihosi Travels & Tours Pvt. Ltd. cannot accept responsibility if you are refused entry to a country or places because you lack the correct visa documentation. Please ensure your passport is valid for 6 months beyond the duration of the trip. Nepal Visa is available on arrival in Nepal.
For Tibet & Bhutan, the company can make necessary arrangements upon request. For India, the client will have to acquire the Visa from their own home country.

MEDICAL CONDITIONS AND SPECIAL REQUIREMENTS

The Company must be notified in writing at the time of booking of any medical conditions, physically challenged conditions or any other mental and or physical condition which may affect fitness to travel and or any medical condition. Failure to notify the Company may result in the client being refused travel. Failure to notify the Company of any such condition that results in cancellation will result in 100% cancellation fees to the Client.
Some trips may be unsuitable for Clients due to age, mobility, pregnancy or physical or mental conditions. It is the Client's responsibility to check prior to booking. The Company is not required to provide any special facilities unless it has agreed to do so in writing. The Company will do its best to meet Clients special requests including dietary, but such requests do not form part of the Contract and therefore the Company is not liable for not providing these requests.
Medical facilities vary from country to country and the Company makes no representations and gives no warranties in relation to the standard of such treatment.

INJURIES AND EVACUATION

Nihosi Travels & Tours Pvt. Ltd. would not be liable for any injury/health conditions/emotional or other conditions suffered by the client during the trip. Similarly, our package cost does not include any personal insurance. Hence, we advise the clients to take adequate insurance packages, including medical emergencies and evacuation by Helicopter.

Use of our Services and Website

You agree you will only use our website or services to make legitimate reservations or purchases and shall not make speculative, false or fraudulent reservations or reservations in anticipation of demand. You will only use our website and services in compliance with applicable law.
Without our prior written permission, you may not (a) access, monitor or copy any content or information on our website using any ``robot``, ``spider`` or other automated or manual device or program, (b) deep link to any portion of our website, or (c) ``frame`` or incorporate any portion of our website into any other website.
Our website may contain links to third party websites that we provide only as a convenience to you. You should take precautions to ensure that whatever links you access are free of viruses, worms, trojan horses or other destructive mechanisms the existence of these links does not imply that we endorse such websites or any included content. We are not responsible for such websites or content or any data privacy practices of such websites.

SERVICES MISSED OR UNUSED

There will be no discounts or monies refunded for missed or unused services, this includes voluntary or involuntary termination/departure from tour, i.e. sickness, death of a family member etc., late arrival on the tour, or premature departure either voluntarily or involuntarily.

BOOKING A TRIP

A 'trip' refers to any product itinerary or activities that you buy with us including Trekking, Tours, Expeditions, and/or other adventure and tour programs.
A booking is accepted and becomes definite only from the date when the Company sends a confirmation invoice or email. It is at this point that a contract between the Company and the Client comes into existence.
Before your booking is confirmed and a contract comes into force, the Company reserves the right to increase or decrease brochure prices.
Please note that the company would not be liable to any warranty, collateral agreement, prior agreement, description of services, or conditions, other than as expressed herein.

UPDATING OF TERMS AND CONDITIONS

The Company reserves the right to update and amend these terms and conditions at any time. It is the responsibility of the Client to keep updated with any changes. The current version of terms and conditions will always be found on the website www.nihositravels.com and will be the terms referred to in any dispute.
